Please read this document carefully. It describes important limitations of 911 service over VoIP. You must sign it before your Service is activated.

IMPORTANT: 911 service over VoIP differs from traditional wireline 911 service. It may be unavailable or limited in the circumstances described below, including during power or internet outages, or if your registered address is not current. Keep an alternative means of reaching emergency services available, such as a mobile phone.

A. How VoIP 911 Service Works

  1. BabbleBlue Communications, a trade name of Jevin Canders LLC ("BabbleBlue," "we," "us"), provides 911 service as a standard, mandatory feature of the Service. You cannot opt out of 911 service.
  2. Traditional wireline 911 service automatically determines your location from the physical phone line. VoIP service travels over the internet and can be used from many locations, so we route your 911 calls based on the physical address you register with us (your "Registered Location").
  3. When you dial 911, we attempt to deliver your call, your callback number, and your Registered Location to the public safety answering point ("PSAP") that serves your Registered Location.

B. Your Registered Location

  1. You must provide a valid physical street address (not a post office box) as the Registered Location for each applicable line or device before we activate your Service.
  2. If you move your device or use it from a new location, your 911 calls may be routed based on your old Registered Location. You must update your Registered Location promptly whenever it changes.
  3. You may update your Registered Location at any time through your account dashboard or by contacting our support team. Updates may take a short period to propagate; until an update takes effect, 911 calls may be routed based on the previous Registered Location.

C. Circumstances in Which 911 Service May Be Limited or Unavailable

911 service over VoIP may be limited, delayed, or unavailable in the following circumstances, among others:

  1. Power outage: VoIP equipment requires power. If you lose power, the Service, including 911, will not work until power is restored, and equipment may need to be reset or reconfigured.
  2. Internet outage or congestion: if your broadband connection fails, is suspended, or becomes overloaded, the Service, including 911, will not work.
  3. Outdated or incorrect Registered Location: your 911 call may be routed to the wrong PSAP, and emergency responders may be dispatched to the wrong address.
  4. Nomadic use: if you move your device to a location other than your Registered Location without updating it, your 911 call may be misrouted, and your correct location will not be transmitted.
  5. Routing and data limitations: 911 calls may reach the PSAP's administrative line, which may not be staffed after hours or by trained 911 operators; and some PSAPs cannot receive automatic callback number or location data, so be prepared to state your location and callback number.
  6. Numbers outside your rate center: if you use a telephone number that is not associated with the geographic area of your Registered Location, 911 routing may be affected.
  7. Account termination: if your Account is terminated and closed, 911 service will not be available. If your Service is merely suspended (for example, for nonpayment), 911 calls remain available, subject to the other limitations in this Section, such as power and internet outages.

D. National Emergency Call Center and Cost Recovery

  1. If a 911 call cannot be routed to the appropriate PSAP because your Registered Location is missing, inaccurate, or outdated, the call may be routed to a national emergency call center, whose operators will attempt to determine your location and transfer the call to the correct PSAP. This process takes longer than direct PSAP routing.
  2. We are charged by third parties for each call handled by the national emergency call center. If such a call results from your failure to provide or maintain an accurate Registered Location, we will pass through a cost-recovery fee of $85 per incident. This fee is nonrefundable. It is not a charge for calling 911; it recovers third-party costs caused by an out-of-date registration.

E. Your Obligations

  1. Maintain an accurate Registered Location for every line and device on your Account, and update it promptly whenever it changes.
  2. Inform every person who may use the Service at your home or organization, including household members, children, babysitters, guests, employees, and contractors, of the limitations described in this document.
  3. Place the 911 warning labels we provide on or near each device used with the Service. We will provide labels at activation and additional labels on request at no charge.
  4. Maintain an alternative means of accessing emergency services, such as a mobile phone, for use during power or internet outages.

F. Limitation of Liability

  1. To the maximum extent permitted by law, BabbleBlue, its officers, agents, employees, and third-party providers are not liable for any claim, damage, or loss arising from the unavailability, failure, outage, misrouting, or degradation of 911 service in the circumstances described in this document or in events beyond our reasonable control, and you waive all such claims, except to the extent caused by our gross negligence or willful misconduct. This Section supplements, and does not limit, the limitation of liability provisions in your customer agreement.

G. Acknowledgment

By signing below, I affirmatively acknowledge, on my own behalf and, if applicable, on behalf of the Customer I represent, that I have received, read, and understand this 911 Service Disclosure, including the circumstances in which 911 service may be limited or unavailable, and I accept the obligations described in Section E. I understand that I am required to inform all users of the Service, including members of my household or organization, of these limitations.
